Got a jury duty summons? What to do as a non-citizen
In short
Why non-citizens receive jury summons, why you must still answer, and how to tell the court you are not a US citizen.
Jury duty means a court asks residents to serve on a jury, a group that decides a court case. Only US citizens can serve on a jury. Even so, many non-citizens receive a summons (an official letter calling you to court), because courts take names from lists like driver's license and ID records.
Do not ignore it
A summons is a court order. If you do not answer, the court may send more letters or order you to appear. Answering is simple.
What to do
1
Read the letter. It may come from a federal court or a state or county court. Both require citizenship.
2
Find the juror qualification questionnaire, on paper or online at the website in the letter.
3
Answer the question "Are you a citizen of the United States?" with No. Answer every question truthfully.
4
Return the form by the deadline. You will be disqualified, which is the normal result. You do not need to explain your visa.
5
Keep a copy or a screenshot of what you sent.
If there is no form, call the jury office on the letter: "I received a jury summons, but I am not a US citizen. What should I do?"
Never claim to be a citizen
Saying you are a US citizen on a jury form, even by mistake, is a false claim to citizenship. It can cause serious immigration problems, including problems with a future green card or naturalization. Read slowly and ask for help if you do not understand a question.
Jury duty scams
Scammers call or text pretending to be court officers. They say you missed jury duty and must pay a fine now or be arrested.
Real courts do not call to demand payment, and never ask for gift cards, wire transfers, crypto or payment apps.
Courts communicate mostly by mail.
If unsure, hang up and call the court using the number on the court's official website.
Common mistakes
Throwing the summons away.
Checking "yes" for citizenship because you have a green card. A green card holder is not a citizen.
Paying a caller who says there is a warrant for missing jury duty.
